NBA 2K publisher Take-Two Interactive wins dismissal of tattoo lawsuit thanks to a decision made by a federal judge in Manhattan against statutory charges claimed by tattoo artist shop Solid Oak Sketches. The tattoo maker said that its eight designs inked on the skins of certain NBA stars were used without authorization from 2K.
Judge Laura Taylor Swain nullified the claims of $150,000 per infringement (that could have been a total amount in the billions had the tattoo maker won), mainly because the tattoos’ designs were registered with the U.S. Copyright Office two years after the presumed infringements occurred.
“The case will proceed, and we look forward to explaining why we are entitled to actual damages,” said Darren Heitner, a lawyer representing Solid Oak Sketches.
