US Supreme Court rules in favor of gaming industry | Corte Suprema de EE.UU. falla a favor de la industria de los videojuegos

The US Supreme Court has made its decision about the case involving the State of California and the gaming industry represented by the EMA. The enforcement of a law written by California State Senator Leland Yee would have not just criminalized the sale of certain M-rated videogames in California, but also turn gaming into a form of entertainment or media not protected by the first amendment of the US Constitution.

Since the arrival of games such as Mortal Kombat and Postal 2, some people have been afraid of the violent content in electronic entertainment, especially for teens. As the gaming industry grew and the content of games was diversified, the ESRB was created as a way to inform parents and all gamers about the content of every game sold.

Still, the state of California insisted that the efforts by the ESRB just weren’t enough, that it fails to protect minors, which should lead to stricter measures to be put in place. The purpose of the California gaming law was to treat violent videogames the same way as extreme sexual material.

In the past, all laws or bills against videogames have been overturned because of the First Amendment which gives people the right of freedom of speech.

It’s a parent’s decision whether to buy an M-rated game for his/her teens. All games come with more specific information than the ratings offered by Hollywood and the film and music industries, thanks to the ESRB.

At Court
The Supreme Court, in a 7-2 ruling, voted in favor of the EMA and the videogame industry by stating “the Federal District Court concluded that the Act violated the First Amendment and permanently enjoined its enforcement.” The Supreme Court said in its syllabus “because the Act imposes a restriction on the content of protected speech, it is invalid,” therefore eliminating the Act signed by former governor and Hollywood star Arnold Schwarzenegger.

The information provided by the State of California was not enough to persuade most of the Supreme Court judges.

La Corte Suprema de los EE.UU. ha tomado una decisión sobre el caso relacionado con el estado de California y la industria de los videojuegos representado por la EMA. La ejecución de una ley escrita por el senador del estado de California, Leland Yee, hubiera no sólo tipificado como delito la venta de ciertos videojuegos clasificados M en California, sino también a su vez habría convertido a los videojuegos en una forma de entretenimiento no protegida por la Primera Enmienda de la Constitución de los EE.UU..

Desde la llegada de juegos como Mortal Kombat y Postal 2, algunas personas han tenido miedo de los contenidos violentos en el entretenimiento electrónico , especialmente cuando se trata para los adolescentes. A medida que la industria del juego creció y el contenido de los juegos fue diversificándose, la ESRB se creó para informar a los padres y a los jugadores del contenido de cada juego vendido.
